Interim Count Atty pursues dangerous path
On Friday May 21, 2010, several local, state, county, and federal officials from the law enforcement community met to communicate concerns to the public with regard to recent statements made by interim County Attorney Rick Romley. Mr Romley recently facilitated the release of several suspects who were in custody for violating the states human smuggling statute, a felony offense. In recent stetements made to the media Romley said he would no longer pursue charges against illegal immigrants as co-conspurators and added that his office would no longer participate in "raiding" businesses under immigration law. Translation: Free pass to those who violate the employer sanctions law.
The courts have validated that the prosecutorial methods used by former County Attorney Andrew Thomas were sufficient to meet the legal constraints required to successfully prosecute

Rule 15 Questionaire
The department recently sent out Rule 15 Questionaire/survey forms that officers were directed to fill out and return. Several officers have raised concerns and called PLEA with questions. The department has assured PLEA that since officers are being compelled to complete the survey that Garrity protections apply. They have also made it clear that the purpose of the survey is NOT to gather information for the purpose of investigating officers. If there are further questions regarding this please call the PLEA office @ 602-246-7869. SB 1070 Changes Nothing for Phoenix Officers

E.J. Montini understands what Phoenix Police Officers already know. The main premises of SB 1070 won't change a thing for Phoenix Police Officers. Phoenix Officers have been contacting ICE and deporting illegal aliens for the last two years.
